TERMS & CONDITIONS
i. ‘Cyclosophie‘ means Cyclosophie, a private liability company established under and governed by the law of the Grand-Duchy of Luxembourg, having its registered office at 6, im Grund, L-6917 Roodt-sur-Syre (Grand-Duchy of Luxembourg) and registered with the Luxembourg Trade and Companies Register under number B257338.
ii. ‘Contract’ means the contract entered into between the Customer and Cyclosophie via the usage of the Website by the Customer and on the baiss of which the Customer purchases a Product from Cyclosophie.
iii. ‘Customer’ means any natural or legal person who uses the Website and purchases or wishes to purchase a Product via the Website.
iv. ‘Product’ means any product that Cyclosophie offers for sale on the Website, including, but not limited to, cycling clothing, casual wear and print-outs.
v. ‘Terms & Conditions’ means the present general terms and conditions of Cyclosophie.
vi. ‘Website’ means the website www.cyclosophie.com and all its underlying webpages, created and owned by Cyclosophie.
II. SCOPE AND APPLICABILITY OF THE TERMS & CONDITIONS
1. The following Terms & Conditions apply to all content and activity on the Website, including, but not limited to, every offering made by Cyclosophie on the Website and every Contract entered into between a Customer and Cyclosophie via the Website, as well as any correspondence by e-mail or other means between the Customer and Cyclosophie.
2. By using the Website, the Customer agrees to the Terms and Conditions in their most recent applicable version displayed on the Website. Further, the Customer will be prompted to accept the Terms & Conditions upon completing an order to purchase. Cyclosophie reserves its right to change the Terms & Conditions at any time in which case the new or amended Terms & Conditions will apply from the date they are posted on the Website.
III. USER ACCOUNT
1. The Customer may create an account on the Website to order Products by following the registration process of the Website. Creating an account in the name of another person or entity is prohibited.
2. To complete the registration process, the Customer must provide certain information to Cyclosophie. The Customer warrants to Cyclosophie that any information provided in this context is correct, complete and up to date. The Customer must change this information where it is no longer correct, complete or up to date.
3. The Customer undertakes to keep her login information (account name and password) secret and refrains from disclosing such login information to third parties. The Customer is liable for any use made of her account.
4. In case the Customer suspects a use of her account by an unauthorised third-party, she must take immediate and effective measures to ensure that the third-party no longer has access to the account and notify Cyclosophie of the unauthorised use of the account by a third-party.
5. Cyclosophie reserves its right to change the login process and any login information when necessary for the Website’s functioning and integrity, or the security of the Customer’s account.
6. The Customer has the right to terminate the account at any time without providing any reasons. Cyclosophie is entitled to terminate a Customer account in case the concerned Customer violates the Terms & Conditions without obligation to provide indemnification to the Customer. For the avoidance of doubt, the termination of an account does not impact the validity of Contracts already concluded between the Customer and Cyclosophie.
IV. OFFER AND CONCLUSION OF A CONTRACT
1. Orders for Products are subject to the concerned Product’s availability and Cyclosophie reserves its right to refuse confirmation of an order made by a Customer at any time.
2. The Customer places an order by following the instructions on the Website.
3. Upon payment of the order, Cyclosophie will send a confirmation of order processing by e-mail to the Customer, also containing the details of the ordered Products.
4. The Contract is concluded and binding on the Customer and Cyclosophie the moment Cyclosophie sends the confirmation of order processing to the Customer by e-mail.
5. Order processing and contacting occurs via e-mail and automated order processing. The Customer must ensure that the e-mail address he provides for the order processing is accurate so that e-mails sent by Cyclosophie can be received at this address. Particularly, if SPAM filters are used, Cyclosophie recommends the Customer to verify her junk/SPAM folder and to contact customer support (support@cyclosophie.com ) in case of needs. The Customer must ensure that all e-mails sent by Cyclosophie, or by third parties commissioned by Cyclosophie with the order processing, can be delivered.
6. While Cyclosophie makes every reasonable effort to ensure that a Product’s size and dimensions are accurately indicated on the Website, indications of sizes and dimensions are approximate.
7. Colors of images uploaded on the Website may change depending on the internet browser and device used by the Customer and Cyclosophie can therefore not guarantee that the colors of a Product are accurately displayed on the Customer’s device and are thus equal to the colors of the delivered Product.
8. Cyclosophie is not bound by apparent errors and typos in the offering on the Website. The Customer acknowledges that the Product delivered may deviate to a limited degree from the information given on the Website, including the images.
9. Cyclosophie reserves its right to adapt the Product, change any information on it or remove it from its Website at any moment, without Cyclosophie incuring any liability in doing so.
V. PRICE AND PAYMENT
1. All prices of Products displayed on the Website are stated in EUROS (€) and include value added tax (VAT). They do not include any additional costs, such as shipping costs and duty. The Customer will pay the price indicated on the Website at the time of order of a Product.
2. Cyclosophie reserves its right to increase or decrease the prices of Products at any time. Such amendments to the Products’ prices have no effect on Products that have already been ordered, but not yet delivered.
3. Unless stated otherwise, all discount codes are applied to the value of the order excluding shipping costs and duty, and cannot be used together with other discounts or sale promotions.
4. The Customer may pay the price using a payment method indicated on the Website. Currently, Cyclosophie accepts payments by common credit cards (Visa, Master Card, American Express, etc.), in which case payments are processed by “stripe”, and Pay Pal.
VI. SHIPPING AND DELIVERY
1. Cyclosophie will deliver the ordered and paid Products to the delivery address indicated by the Customer while using postal services partners (“Post Luxembourg” etc.) and their third-party partners. Shipping options and costs will be displayed at checkout and vary depending on courier, service, and destination.
2. If the Customer makes several orders, Cyclosophie is entitled to make partial deliveries.
3. For orders over EUR 135.00 to EU countries, UK, Switzerland, Norway, Iceland and Liechtenstein, shipping with postal services will be free.
4. Cyclosophie generally ships an order within 2-3 working days after the processing of the order has been confirmed. You will receive an e-mail once your package has been shipped. In case of extraordinary circumstances, the processing time could amount to 4-5 working days.
5. All orders are managed and shipped from Cyclosophie’s warehouse based in Luxembourg.
– Delivery in 3-5 working days for EU countries.
– Delivery by 5-10 working days to countries outside the EU.
6. Art prints are shipped directly from our third-party service provider to the Customer and delivery generally takes around 10 working days.
7. The delivery times indicated here above and on the Website (notably during the ordering process), are indicative and cannot be considered legally stringent deadlines.
8. For orders under 135 € and most non-EU countries we apply the following shipping costs:
– 5 € for Luxembourg
– 12 € for EU countries, UK, Switzerland, Norway, Iceland and Liechtenstein
– 20 € for the rest of world
9. This flat rate covers only the shipping cost and does not include duties, taxes, or other import charges levied by the importing country.
10. For non-EU Countries Cyclosophie is not liable for any local import duties and taxes.
11. In case of failure to collect the package or refusal of the delivery from the recipient, the latter bears the costs for the failed delivery.
12. Cyclosophie will send coupons or gift cards to the Customer by e-mail
VII. RETURN POLICY
1. The Customer may return the items within 14 days from the order delivery date under the following conditions:
– Returned items must have all the tags.
– Items must be in original condition, unwashed and unworn.
– Items must be without any scuffs, scratches, stains or hair.
– In case the Customer wants to return a bundle (a pack of Products), the Customer has to return all the Products included in the bundle.
– The Customer has to try on clothes with underwear while avoiding to use make-up or strong perfume.
2. The Customer will bear the costs of the return shipping. Cyclosophie strongly recommends using a shipping method that provides a tracking number. Once Cyclosophie receives the Customer’s return, it will send an email notification to the Customer and the latter will receive a refund of the purchase price using the Customer’s original payment method. Postage fees will not be refunded, except if the item(s) are faulty or if the Customer has received the wrong product.
3. To return an item, the Customer must:
a. Fill out the return form provided with the order.

VIII. EXCHANGE POLICY
1. The ordered clothes may be exchanged for the same item in a different size. The Customer will bear the costs of the return shipping, however she will not have to pay for the shipment in the new size.
2. The Customer may exchange the items within 14 days from the order delivery date under the following conditions:
– Exchanged items must still have all the tags.
– Items must be in original condition, unwashed and unworn.
– Items must be without any scuffs, scratches, stains or hair.
– The Customer has to try on clothes with underwear while avoiding using make-up or strong perfume.
3. To exchange an item, the Customer must:
a. Check online whether her item is still available in the desired new size. If not, the Customer may choose a different design of the same price (the exchange conditions will still apply), or she may return her item for good (the return conditions will apply in this case).
b. Send an email to support@cyclosophie.com with her order number, item reference, her ordered size, her desired new size (and if not available, her desired new design). Cyclosophie makes all reasonable efforts to put the Product aside for the Customer and will inform her if the desired Product has become unavailable in the meantime.
c. Fill out the return form provided with her order.

4. Cyclosophie will send the new garment to the Customer as soon as it has received the item the Customer would like to exchange.
IX. DAMAGED ITEMS
1. Cyclosophie is committed to providing its customers with the absolute best products and check every single item before sending them. However, Cyclosophie recommends its customers to check delivered Products for any damage and production problems.
2. If the Customer believes that the delivered Product suffered production or shipping damage, it must contact Cyclosophie by e-mail: support@cyclosophie.com, and add proof by including pictures of the damaged Products to the e-mail. Cyclosophie will answer claims of damaged items as soon as reasonable possible.
X. COPYRIGHT AND TRADEMARKS
1. This Website and its content are created and owned by Cyclosophie. As such they, are protected by copyright and trademark law. They include any information and elements available on the Website, such as texts, designs (including clothing designs), photographs, illustrations, images, and logos.
2. Any use of all or part of these elements, by any means, in any form and for any purpose whatsoever, is prohibited, except with the express prior written consent of Cyclosophie.
XI. PRIVACY AND COOKIES POLICY
1. Cyclosophie processes the data provided by the Customer in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), as well as applicable local law.
2. By using the Website, the Customer consents to the use, storage and processing of its information in accordance with Cyclosophie’s privacy policy.
3. Cyclosophie uses cookies to enhance the Customer’s shopping experience and enable Cyclosophie to handle your orders and logging. If the web-browser is set to not accept cookies, the Customer will not be able to use the online shop.

XII. LIMITATION OF LIABILITY
1. Cyclosophie may not be held liable for breach of contract in case of absence or unavailability of a Product, a force majeure, interruption, total strike of postal and courrier services and/or transport and/or telecommunications.
XIII. APPLICABLE LAW AND CHOICE OF JURISDICTION
1. The law of the Grand-Duchy of Luxembourg shall apply to all legal relationships between the Customer and Cyclosophie, and the District Court of Luxembourg-City, Grand-Duchy of Luxembourg, is exclusively competent for any legal disputes arisings among the Customer and Cyclosophie.
